Fiduciary is a word we do not hear every day so I will break down what the fiduciary duty of a REALTOR to a client is in simple terms.
A realtor owes their clients fiduciary duties, which are legal and ethical obligations that require them to act in the best interests of their clients. These duties include:
1. Loyalty: Realtors must prioritize their clients' interests above their own and avoid any conflicts of interest. They should not engage in any activities that could compromise their loyalty to their clients.
2. Disclosure: Realtors have a duty to provide their clients with all relevant and material information about a property or transaction. This includes disclosing any known defects, potential risks, or other factors that could affect their clients' decision-making process.
3. Confidentiality: Realtors must keep their clients' information confidential, both during and after the transaction. They should not disclose any personal, financial, or confidential information without their clients' consent, unless required by law.
4. Obedience: Realtors are obligated to follow their clients' lawful instructions and act in accordance with their wishes, as long as they are within the bounds of the law and ethical standards.
